Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.
By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.
WAKHAL is a personal mental wellbeing app designed to help users track moods, practice mindfulness, journal thoughts, and access mental wellbeing resources. The App is not a substitute for professional medical advice, diagnosis, or treatment.
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device. You agree to accept responsibility for all activities that occur under your account.
WAKHAL is not a medical service and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The App is designed as a self-help tool and should not be used as a substitute for professional medical advice, diagnosis, or treatment.
Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or seen in the App.
If you are experiencing a medical emergency, call your local emergency services immediately or visit the nearest emergency room or urgent care center.
WAKHAL may provide information about crisis support services, but it is not a crisis intervention service. If you or someone you know is experiencing a mental wellbeing crisis or having thoughts of suicide, please contact a mental wellbeing professional, go to your nearest emergency room, or call your local emergency services or suicide prevention hotline immediately.
WAKHAL is intended for users who are at least 16 years of age due to the mature nature of mental wellbeing content and assessment tools. By using the App, you represent and warrant that you are at least 16 years old. If you are under 16, you may not use the App.
If we learn that we have collected personal information from someone under 16, we will delete that information as quickly as possible. If you believe that we might have collected information from someone under 16, please contact us at wakhal@kangleicode.in.
Our App allows you to create and store content such as journal entries, mood logs, and other personal information. You retain all rights to your content, but you grant us a license to use, store, and process this content for the purpose of providing and improving our services.
You are solely responsible for the content you create using our App and must ensure it does not violate any laws or these Terms.
WAKHAL includes AI-powered features that provide personalized insights and suggestions based on your mood and journal data. These features use anonymized data and are designed to enhance your wellbeing experience.
AI-generated content is for informational purposes only and should not be considered professional medical advice. The AI features include daily usage quotas to ensure responsible use and cost management.
We do not store AI conversations long-term, and all AI processing respects your privacy and data protection rights.
WAKHAL uses a hybrid storage system combining local device storage and secure cloud storage (Firebase) to provide cross-device synchronization and offline functionality.
Your data is encrypted in transit and stored securely. We implement a 30-day rolling data retention policy for mood entries to optimize performance while maintaining your privacy.
You can export your data at any time and have complete control over data deletion through the app's settings.
You agree not to use the App for any purpose that is prohibited by these Terms or by law. Prohibited conduct includes:

The App and its original content, features, and functionality are and will remain the exclusive property of KangleiCode and its licensors. The App is protected by copyright, trademark, and other laws of both India and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of KangleiCode.

If you download WAKHAL from the Apple App Store or Google Play Store, you acknowledge and agree that:
WAKHAL is provided free of charge. The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the App will be uninterrupted, error-free, or completely secure. You use the App at your own risk.
In no event shall KangleiCode, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you can do so by using any of the following methods:

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015 of India, conducted in English in Manipur, India.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced with a valid and enforceable provision that most closely matches the intent of the original provision.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
